7.18 DISCIPLINARY REVIEW HEARING PROCEDURES*

   Initiation — The Assistant Director may initiate a Disciplinary Review Hearing if he or she believes that the written criteria of the disciplinary program established during the disciplinary probation period are not being met adequately, or in the case of illegal behavior. Any teacher, counselor, or staff member who feels that the student is not meeting the written criteria of the disciplinary program established during the disciplinary probation period, may bring this to the attention of the Assistant Director. If a disciplinary review hearing is to be held, the Assistant Director will notify, in writing, the student, the student’s parent(s)/guardian(s), the student’s teachers, administration, counselor, and Executive Teachers of the upcoming hearing and include an explanation of the reasons for the dismissal hearing.  

    Evaluation — Upon initiation of such a request, a Disciplinary Review Committee will be formed consisting of three faculty members who will be selected from the Faculty Review List. The Faculty Review List will be initially formed by an alphabetical listing of all voting faculty who have taught at University Laboratory High School for at least two years.

  The Faculty Review List will be appended to the Faculty Handbook and updated yearly. At the beginning of each school year, the list will be updated by removing names of faculty who are not teaching at University Laboratory High School and adding, in alphabetical order, the names of faculty who are voting faculty and have met the two-year teaching requirement. The selection of faculty members will begin where it left off the previous year, not at the top of the alphabetical list.

  Faculty members may be excused from the Disciplinary Review Committee if more than one of the three faculty members are from the same academic department or if a conflict of interest is identified by the Assistant Director, one of the faculty members, the student, or his/her parent(s)/guardian(s). The Assistant Director will conduct the hearing and serve as a non-voting member of the Disciplinary Review Committee. A review hearing will be conducted to:

  1. Review the requirements of the disciplinary probation program;

2. Determine the level of cooperation by student and  parent(s)/guardian(s) during the disciplinary probation period;

3. Determine the potential value of continuing the probation-ary program for a longer period;

4. Determine the possible effectiveness of alternative disci-plinary programs;

5. Determine the possible value to the student of a different  educational environment.

  The Committee will, in closed session, conduct its hearing in two parts:

  Part I: The Committee will gather and review evidence/information about the incident in which the student appearing was involved and decide whether a violation occurred. During this time, the Review Committee will review available evidence. The Committee may consider statements from the student, staff members, parent(s)/guardian(s), other students, and the student’s academic, extracurricular, and residential record at Uni. After all evidence has been presented, the student, all witnesses, parent(s)/guardian(s), and advisers will be excused.  

Part II: The Committee meets in closed session to determine if the violation occurred and if so, the appropriate sanction. The Committee may review the student’s official school record to assist in determining an appropriate sanction. The Committee will decide one of the following:

  1. Dismissal.

2. Re-institution of disciplinary probation proceedings to determine a revised disciplinary program which may include the loss of privileges such as free periods, extra-curricular activities, and other privileges.

NOTE: If the Committee decides to re-institute the disciplinary probation proceedings, a revised remediation program will be created. If a student does not follow the expectations of this remediation program, another Disciplinary Review Hearing will occur.

    Action — The decision of the Committee will be communicated in writing to the student, his/her parent(s)/guardian(s), teachers, administration, counselor, and Executive Teachers by the Assistant Director. The statement must contain a description of: (1) the misconduct involved; (2) the evidence available; (3) the decision of the Disciplinary Review Committee; (4) the consequences of the misconduct; and (5) the available appeal option and procedures. In case of a decision other than dismissal, the procedures relating to Disciplinary Probation shall be followed. 

    Appeal — The student and/or his/her parent(s)/guardian(s) may appeal the decision in writing to the Director/Principal of University Laboratory High School, who will review the evidence examined by the Review Committee and any additional evidence presented by any party involved. The appeal must be made within two school days after the student has received the written decision from the Assistant Director. 

      Action — The Director/Principal will make the final decision on the appeal, and communicate his/her decision in writing to the student, parent(s)/guardian(s), teachers, administration, counselor, Executive Teachers, the Disciplinary Review Committee, and the Provost’s Office. All action to dismiss the student shall be postponed until the appeal procedure has been completed, unless the student presents a danger to the well-being of others in the school.
